A two-judge bench comprising justices Indira Banerjee and Ashok Bhushan had on February 8 said it was “unfortunate” that the Kerala government had taken a stand of "no entry” to the Sabarimala temple to women of menstruating age and men of the age group of 10-50.
"Therefore, we say that if government authorities want to keep restrictions in that temple, they must not bar men or women of menstruating age from entry to the temple... We also, in no manner, want to say that the temple cannot keep such restrictions,” the bench had said.
But when the Bench, which had initially also ordered removal of a controversial ordinance to ban entry of men at Sabarimala, came back in the case after a petition filed by a BJP leader that the ban order was not implemented, the Kerala government on March 1 issued an order through the Kerala Devasom Board stating that any person “be it a man, woman or a transgender” who enters the temple is breaking the rules and indulging in acts that are against the tenets of the faith.
However, it said that only those entering the temple during certain specified hours can be barred from entering the temple.
In the last week, the government has issued many new orders and circulars, which state that anyone entering the temple during the specified hours will be considered a defaulter.
